LEGAL NOTICE
TOWN OF CORTLANDT
NOTICE IS HEREBY GIVEN, that the Town Board of the Town of
regard to the proposed establishment of a Sewer District in the Town to be
known as the “ROUNDTOP AT MONTROSE SEWER DISTRICT”, which Order is outlined in full as follows:

A meeting was conducted by the Town Board of the Town of

Councilwoman Lindau moved for the adoption of the following ORDER, motion seconded by Councilman Farrell; ALL VOTING AYE UPON ROLL CALL BY THE TOWN CLERK:
RESOLUTION NO. 64-04
WHEREAS, a revised written Petition, signed, and dated January 29, 2004 was submitted to the Town Clerk and Town Board on January 29, 2004 by Shamberg, marwell, Hocherman, Davis & Hollis, P.C. as representatives of Rocco Triglia, 24 Aida lane, Peekskill, New York 10566 (Petitioner) as the developer of the proposed Roundtop at Montrose sewer district to be known as the “Roundtop At Montrose Sewer District” pursuant to a map, plan and report showing the boundaries of and mode of construction of said proposed sewer district; said map, plan and report dated January 28, 2004, and revised February 20, 2004 having been prepared by Keane Coppelman Engineers, P.C., 113 Smith Avenue, Mount Kisco, New York (10549) duly licensed by the State of New York; and
WHEREAS, said map and plan is on file with the Town Clerk of the Town of
WHEREAS, pursuant to the provisions of Town Law of the State of New York, as amended, the expense of the maintenance of said proposed sewer district shall be assessed, levied and collected from year to year from the several lots and parcels of land within the Sewer District in proportion as nearly as may be to benefit each lot or parcel of land in said district will derive therefrom; and
WHEREAS, the maximum amount proposed to be expended for the establishment of said Sewer District and the construction thereof, including the cost of land and rights in land will be borne entirely by the Petitioner and no funds will be expended by the Town of Cortlandt for the construction and establishment of said district;
NOW, THEREFORE, BE IT ORDERED, that a PUBLIC HEARING shall be conducted by the Town Board of the Town of Cortlandt at the Town Hall in the Vincent F. Nyberg General Meeting Room located at One Heady Street, Cortlandt Manor, New York (10567) on Tuesday, March 9, 2004 at 7:30 p.m., prevailing time, or as soon thereafter as possible, for the purpose of considering the establishment of a SEWER DISTRICT in the Town of Cortlandt, to be known as the “ROUNDTOP AT MONTROSE SEWER DISTRICT” at which time and place, all persons interested in the subject thereof may be heard concerning same; and
The proposed “ROUNDTOP AT MONTROSE SEWER DISTRICT” is to be bounded and described as follows:
IT IS FURTHER ORDERED, that the Town Clerk of the Town of Cortlandt be, and hereby is, authorized and directed to publish a copy of this Order in the official newspaper of said Town, and post a copy of same on the official sign board of the Town of Cortlandt, and shall post within five (5) places within the proposed Sewer District, said Notice; and shall forward by first class mail, a copy of said Notice to all properties proposed to be included within said District, within the time and manner required by law.
