NOTICE IS HEREBY GIVEN, that the Town Board of the Town of
August, 2004 at 7:30 p.m. prevailing time, in the Vincent F. Nyberg Meeting
Room at the Town Hall located at

Councilwoman Lindau moved for the adoption of the following ORDER, motion seconded by Councilman Sloan; ALL VOTING AYE UPON ROLL CALL BY THE TOWN CLERK:
RESOLUTION NO. 240-04
WHEREAS, a revised written Petition, signed, and dated July 20, 2004 was submitted to the Town Clerk and Town Board on July 20, 2004 by as representative of Mr. William Balter of Wilder Balter, Partners, LLC of 570 Taxter Road, 6th Floor, Elmsford, New York (10523) (Petitioner) as the developer of the propose First Extension of the Jacobs Hill sewer district to be known as the “FIRST EXTENSION OF THE JACOBS HILL SEWER DISTRICT” pursuant to a map, plan and report showing the boundaries of and mode of construction of said proposed sewer district; said map, plan and report dated July 20, 2004 having been prepared by Ralph G Mastromonaco, P.E., P.C., 13 Dove Court, Croton-on-Hudson, New York (10520) duly licensed by the State of New York; and
WHEREAS, said map, plan and report is on file with the Town Clerk of the Town of
WHEREAS, pursuant to the provisions of Town Law of the State of New York, as amended, the expense of the maintenance of said proposed sewer district shall be assessed, levied and collected from year to year from the several lots and parcels of land within the Sewer District in proportion as nearly as may be to benefit each lot or parcel of land in said district will derive therefrom; and
WHEREAS, the maximum amount proposed to be expended for the establishment of said Sewer District and the construction thereof, including the cost of land and rights in land will be borne entirely by the Petitioner and no funds will be expended by the Town of Cortlandt for the construction and establishment of said district;
NOW, THEREFORE, BE IT ORDERED, that a PUBLIC HEARING shall be conducted by the Town Board of the Town of Cortlandt at the Town Hall in the Vincent F. Nyberg General Meeting Room located at One Heady Street, Cortlandt Manor, New York (10567) on Tuesday, August 17, 2004 at 7:30 p.m., prevailing time, or as soon thereafter as possible, for the purpose of considering the establishment of a SEWER DISTRICT in the Town of Cortlandt, to be known as the “FIRST EXTENSION OF THE JACOBS HILL SEWER DISTRICT” at which time and place, all persons interested in the subject thereof may be heard concerning same; and
The proposed “FIRST EXTENSION OF THE JACOBS HILL SEWER DISTRICT” is to be bounded and described as follows:
FIRST EXTENSION OF JACOBS HILL SEWER DISTRICT
DESCRIPTION OF DISTRICT
ALL that certain plot, piece of parcel of land, situate, lying and being in the Town of Cortlandt, County of Westchester and State of New York, as shown on a map entitled First Extension of Jacobs Hill Sewer District Map and Plan prepared by Ralph G. Mastromonaco, P.E., P.C. dated July 20, 2004, being more particularly bounded and described as follows:
BEGINNING at the point of intersection of the southerly boundary of Bear Mountain State Parkway and the easterly boundary of lands shown on a certain map entitled “Forest View at Westchester”, said map being recorded in the Office of the Westchester County Clerk on June 4, 1992 as Map No. 24643;
RUNNING THENCE along the southerly boundary of
1. N 84° 28' 54" E a distance of 471.81 feet;
2. N 82° 02' 54" E a distance of 732.85 feet;
3. N 81° 15' 54" E a distance of 191.24 feet;
4. N 81° 56' 54" E a distance of 129.85 feet;
5. S 62° 55' 03" E a distance of 310.23 feet;
THENCE, turning and running through lands now or formerly of Pike Realty, Inc. and along the boundary of Jacobs Hill Sewer District as shown on a map entitled Jacobs Hill Sewer District, District Map, Description and Plan dated June 13, 1990 prepared by the Town of Cortlandt Engineering Department the following eight (8) courses and Distances:
1. S 12° 19' 30" E a distance of 32.42 feet;
2. S 11° 40' 00" E a distance of 157.29 feet;
3. S 10° 47' 00" E a distance of 68.51 feet;
4. S 14° 02' 00" E a distance of 38.74 feet;
5. S 10° 50' 00" E a distance of 176.71 feet;
6. S 12° 03' 00" E a distance of 71.25 feet;
7. S 82° 45' 50" W a distance of 416.65 feet;
8. S 81° 53' 00" W a distance of 98.10 feet to a point on the Easterly Boundary of lands shown on a map entitled Subdivision Plat and Boundary Line Adjustment Society Hill II at Westchester, Filed in the Office of the Westchester County Clerk on February 18, 1988 as Map No. 23120;
RUNNING THENCE along the Easterly Boundary of the aforementioned Filed Map No. 23120 the following eight (8) courses and distances:
1. S 82° 30' 45" W a distance of 482.10 feet;
2. N 32° 27' 50" W a distance of 104.02 feet;
3. N 32° 33' 50" W a distance of 121.98 feet;
4. N 32° 41' 50" W a distance of 73.69 feet;
5. N 33° 14’ 50” W a distance of 123.00 feet;
6. N 33° 39’ 50” W a distance of 179.80 feet;
7. S 60° 48’ 10” W a distance of 193.83 feet;
8. S 59° 56’ 20” W a distance of 65.54 feet to a point;
THENCE, turning and running through lands now or formerly Pike Realty, Inc. the following three (3) courses and distances:
1. N 30° 28’ 58” W a distance of 101.49 feet;
2. N 89° 07’ 41” W a distance of 58.26 feet;
3. S 58° 33’ 38” W a distance of 97.85 feet to a point on the easterly line of lands shown on the map entitled “Forest View at
RUNNING THENCE along easterly line of lands shown on Filed Map No. 24643 the following three (3) courses and distances:
1. N 38° 16’ 30” W a distance of 56.07 feet;
2. N 41° 59’ 50” W a distance of 42.91 feet;
3. N 39° 37’ 50” W a distance of 154.93 feet to the Point or Place of BEGINNING.
IT IS FURTHER ORDERED, that the Town Clerk of the Town of Cortlandt be, and hereby is, authorized and directed to publish a copy of this Order in the official newspaper of said Town, and post a copy of same on the official sign board of the Town of Cortlandt, and shall post within five (5) places within the proposed Sewer District, said Notice; and shall forward by first class mail, a copy of said Notice to all properties proposed to be included within said District, within the time and m
