Town Board Minutes

A Special meeting of the Town Board of the Town of Cortlandt was conducted on Monday, November 4, 2002 at 8:00 o'clock p.m. in the Vincent F. Nyberg Room of Cortlandt Town Hall, One Heady Street, Cortlandt Manor, NY (10567) with the following elected officials and appointed staff in attendance:

MEETING CALLED to ORDER
Supervisor Puglisi called the meeting to order at 8:00 p.m.

The Supervisor then led all in attendance in a Pledge to the Flag.

ROLL CALL
Town Clerk Jo-Ann Dyckman took roll call that indicated the absence of Councilmember Joseph Cerreto. (Attending a Commanding General course at West Point Monday evenings until January, 2003.)

RECEIVE and FILE
Councilmember Sloan moved that the following document be received and ordered filed, seconded by Councilmember Lindau:

Tentative 2003 budget.

There was no discussion. All voted AYE.

RESOLUTIONS

Councilmember Lindau moved to adopt the following resolutions, seconded by Councilmember Sloan:

RESOLUTION NO. 323-02 - RE: Schedule a Public Hearing for Tuesday, December 10, 2002 at 7:30 p.m. to consider adoption of the preliminary 2003 budget.

RESOLUTION NO. 324-02 - RE: Order and consent for dedication of "Amato Drive East, Amato Drive West and Jay Road located in Blue Jay Estates.

There was no discussion. All voted AYE.

Councilmember Lindau moved that the following resolution be adopted, seconded by Councilmember Sloan:

RESOLUTION NO. 325-02 - RE: Authorize a waiver of monitoring fees for an approved railroad spur for Sandport Supply.

Discussion: Councilmember Farrell said he is not comfortable with waiving a monitoring fee since these fees would generate sufficient income to cover monitoring costs. Overall and on the average the Town would cover its costs. For that reason he is not comfortable going from what would be a substantial fee to virtually nothing. His other concern is that it may lead to other developers wishing to make their own side arrangements separate and apart from the Town's policy.

Supervisor Puglisi said the request came from the applicant and had been officially received and filed on a Town Board agenda and referred to the various departments. She said she doesn't know if we necessarily have neither the manpower nor the expertise to implement this kind of a railroad spur. Her reason for not voting on it at the last Town Board meeting was that she wanted to find out what CSX was going to do as far as monitoring and the Board now, since she has more specifics she is comfortable voting for it.

A poll of the board was as follows:

ADJOURNMENT
At 8:15 p.m. Councilmember Lindau moved the meeting be adjourned, seconded by Councilmember Sloan. All voted AYE.
