PB 13-05, Planning Board Public Hearing - Mill Court Crossing

PUBLIC HEARING NOTICE

PLEASE TAKE NOTICE, that the PLANNING BOARD of the TOWN OF CORTLANDT will conduct a Public Hearing on the application submitted by Kirquel Development for Preliminary Plat Approval pursuant to Sections 276 & 277 of the New York State Town Law and pursuant to Chapter 265 (Subdivision of Land) of the Town of Cortlandt Code and for Permits pursuant to Chapter 179 (Freshwater Wetlands), Chapter 259 (Steep Slopes) and Chapter 283 (Trees) of the Town of Cortlandt Code.  This application includes a Final Environmental Impact Statement (FEIS) entitled “Residences at Mill Court Crossing” prepared by Tim Miller Associates dated January 14, 2010 pursuant to Part 617 of the implementing regulations pertaining to Article 8 New York State Environmental Quality Review Act (SEQRA) of the New York State Environmental Conservation Law.

     The subject application (and the FEIS as submitted) is for a proposed 22 lot conventional subdivision with proposed roads, utilities and other related site improvements on 52.78 acres as shown on a 15 page set of drawings entitled “Subdivision and Site Development for Residences at Mill Court Crossing” prepared by Cronin Engineering, P.E., P.C. latest revision dated July 8, 2009 and on drawings entitled “Preliminary Landscape Plan” and “Stone Wall Plan” both prepared by Tim Miller Associates, Inc. and dated July 21, 2009.

A Final Environmental Impact Statement, entitled "Residences at Mill Court Crossing" dated January 14, 2010 prepared by Tim Miller Associates has been completed and accepted by the Town of Cortlandt Planning Board as Lead Agency for the subject application which is a SEQRA Unlisted Action.

     As stated in the "Notice of Completion of a Final Environmental Impact Statement (FEIS) for an Unlisted Action” dated February 2, 2010, the above mentioned FEIS has been completed and accepted by the Town of Cortlandt Planning Board as the Lead Agency for the proposed action.  Comments on the FEIS are requested and will be accepted in writing by the Planning Board until March 12, 2010 (unless extended by the Planning Board).

Potential large impacts of the subject proposed action are as follows: (1) The proposed action may significantly impact existing air quality, ground and surface water quality and quantity, traffic and noise levels and result in a substantial increase in potential for erosion, flooding and drainage problems. (2) The proposed action will result in the removal and destruction of large quantities of vegetation and fauna and may substantially interfere with the habitat and movement of resident wildlife species. (3) The proposed action will result in the attracting of a large number of people to a place compared to the number of people who would come to such a place absent the action. (4) The proposed action will result in a demand for additional community services such as school, police, fire, ambulance, sanitation, roadway maintenance and an additional demand on the Town’s water supply system. (5)  The proposed action may significantly impact a site with archaeological/historical importance. (6) The subject project is located within the emergency evacuation area for the Indian Point Nuclear plants. (7) When considered with other development in the area, cumulative effects on the above mentioned items (1) – (6) may also be significant.

The subject property of 52.78 acres is located on the west side of Lexington Ave. and at the south end of Mill Court and is designated on the Town of Cortlandt Tax Maps as Section 13.18, Block 2, Lot 2.

            Persons may review said FEIS, application and drawings at the Planning Office, Town Hall, 1 Heady Street, Cortlandt Manor, New York, between the hours of 9:00 A.M. and 4:00 P.M., Monday through Friday, except holidays. A limited number of copies of the FEIS are available on a loan basis. A fee will be charged to persons requesting their own copy of the FEIS. A copy of the FEIS is also available for review at the John C. Hart Memorial Library, 1130 Main Street,  Shrub Oak, NY  10588 and the Putnam Valley Library, 30 Oscawana Lake Road, Putnam Valley, NY 10579.   The FEIS can also be reviewed on the internet at www.townofcortlandt.com

SAID HEARING will be conducted in the Vincent F. Nyberg General Meeting Room at the Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York, on Tuesday evening, March 2, 2010 at 8:00 P.M. or as soon thereafter as possible at which time all interested persons will be heard.

     The Town Hall is handicapped accessible.
