Planning Board Public Hearing - Hersh Plaza (PB 24-06)

PUBLIC HEARING NOTICE

PLEASE TAKE NOTICE, that the PLANNING BOARD of the TOWN OF CORTLANDT will conduct a Public Hearing on the application submitted by Ace Sport Realty Holding Corp., c/o Phillip Hersh, for Site Development Plan approval pursuant to Chapter 307, Article XII (Site Development Plan Approval) and for Permits pursuant to Chapter 179 (Wetlands) Chapter 259 (Steep Slopes) and Chapter 283 (Trees) of the Town of Cortlandt Code.  This application includes a Draft Environmental Impact Statement (DEIS), entitled “Hersh Plaza” dated February 5, 2010 prepared by Tim Miller Associates, Inc. pursuant to Part 617 of the implementing regulations pertaining to Article 8 New York State Environmental Quality Review Act (SEQRA) of the New York State Environmental Conservation Law.

The subject application (and the DEIS as submitted) is for two retail/office buildings totaling approximately 27,400 sq. ft. and other related site improvements as shown on a 7 page set of drawings entitled “Retail/Office Buildings Main Street Plaza” prepared by Ralph G. Mastromonaco, P.E. latest revision dated May 19, 2008.

            As stated in the "Notice of Completion of a Draft Environmental Impact Statement (DEIS) for an Unlisted Action” dated March 2, 2010, the above mentioned DEIS has been completed and accepted by the Town of Cortlandt Planning Board as the Lead Agency for the proposed action.  Comments on the DEIS are requested and will be accepted in writing by the Planning Board until May 14, 2010 (unless extended by the Planning Board).

Potential large impacts of the subject proposed action are as follows: (1) The proposed action may significantly impact existing air quality, ground and surface water quality and quantity, traffic and noise levels and result in a substantial increase in potential for erosion, flooding and drainage problems. (2) The proposed action will result in the removal and destruction of large quantities of vegetation and fauna and may substantially interfere with the habitat and movement of resident wildlife species. (3) The proposed action will result in the attracting of a large number of people to a place compared to the number of people who would come to such a place absent the action. (4) The proposed action will result in a demand for additional community services such as police, fire, ambulance, sanitation, roadway maintenance and an additional demand on the Town’s water supply system. (5) The subject project is located within the emergency evacuation area for the Indian Point Nuclear plants. (6) When considered with other development in the area, cumulative effects on the above mentioned items (1) – (5) may also be significant.

The subject property of 2.08 acres is zoned CD, Designed Commercial and is located on the north side of Route 6 at the intersection with the Bear Mountain Parkway and Jacobs Hill Road and is designated on the Town of Cortlandt Tax Maps as Section 23.20, Block 1, Lots 2 & 3.

              Persons may review said DEIS, application and drawings at the Planning Office, Town Hall, 1 Heady Street, Cortlandt Manor, New York, between the hours of 9:00 A.M. and 4:00 P.M., Monday through Friday, except holidays. A limited number of copies of the DEIS are available on a loan basis. A fee will be charged to persons requesting their own copy of the DEIS. A copy of the DEIS is also available for review at the John C. Hart Memorial Library, 1130 Main Street,  Shrub Oak, NY  10588.   The DEIS can also be reviewed on the internet at www.townofcortlandt.com

SAID HEARING will be conducted in the Vincent F. Nyberg General Meeting Room at the Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York, on Tuesday evening, May 4, 2010 at 8:00 P.M. or as soon thereafter as possible at which time all interested persons will be heard.

     The Town Hall is handicapped accessible.
