Public Hearing - Zoning Amendments: CROS

            PLEASE TAKE  NOTICE that the PLANNING BOARD of the TOWN OF CORTLANDT will conduct a Public Hearing pursuant to Cortlandt Town Board Resolution No. 170-06 requesting a recommendation to amend the text of the Town of Cortlandt Zoning Ordinance (Chapter 307) to require that individual single-family residences proposed to be constructed within the Conservation Recreation Open Space (CROS) Zoning Districts of the Town be subject to a limited Site Development Plan Approval by the Planning Board concerning the location of the house, driveway and the limits of disturbance of property. 

            Said Public Hearing will be held on Tuesday, June 6, 2006 at 8:00 P.M., or as soon thereafter as possible, in the Vincent F. Nyberg General Meeting Room at Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York, to receive public comments and input, with respect to the proposed amendment to the CROS District as contained in the Town of Cortlandt Zoning Ordinance (Chapter 307) as follows:

1.  Add to Article IV, General Regulations, Section 307-12.2, Conservation, recreation and open space districts (CROS) as follows:

G.     Site development plan approval by the Planning Board shall be required for the erection or enlargement of all one-family residences and accessory buildings in the CROS District pursuant to Article XII (Site Development Plan Approval) of this Chapter.   In all cases where any amendment of any such plan is proposed, the applicant must also secure the approval of the amendment by the Planning Board.  No building permit shall be issued until conditions of approval are satisfied and the Chairman of the Planning Board has signed the approved site development plan.

2. Amend Article XII Site Development Plan Approval , Section 307-66.A. Approval requirements for major proposals as follows:

A. Site development plan approval by the Planning Board shall be required for the erection or   enlargement of all buildings, including one family residences and accessory buildings in the CROS District, but not for one- or two-family residences in all other districts, for all commercial, industrial and other nonresidential uses of land where no building is proposed, for changes of use from one manufacturing use to another and for changes in use as defined by this chapter.

D. Applications for site development plan approval for a one family residence and accessory buildings in the CROS district shall include information as noted in Section 307.71.A.&B. and as required by the most recent Town Department of Technical Services Building Permit Checklist.

Anyone interested in addressing comments on the above to the Planning Board may do so by appearing in person at the above time and place or by submitting their written comments to the Cortlandt Planning Office no later than 3:00 P.M. on June 6, 2006.
